US states that distinguish between betting cash on games of chance to betting cash on games of skill

As stated in my article of January 5 th , most states in the US apply the dominance test meaning these states differentiate between playing skill games or playing games of chance. In the other states any online game played for money is illegal.

The states in which the dominant factor is used are : Alabama , Alaska , California (Effectively used), Colorado , Connecticut , Dist. of Columbia, Georgia, Hawaii, Idaho, Indiana, Kansas, Kentucky, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Utah, Virginia, Washington and West Virginia, Wisconsin, Wyoming.

 The states in which the dominant factor test is not used are : Arizona , Arkansas , Florida , Illinois , Iowa , Louisiana and Maryland .

The states in which it is not yet clear whether the dominant factor test is used are : Delaware , Montana , Tennessee and Vermont .
