US states that distinguish between betting cash on games of chance to betting cash on games of skill The states in which the dominant factor is used are : Alabama , Alaska , California (Effectively used), Colorado , Connecticut , Dist. of Columbia, Georgia, Hawaii, Idaho, Indiana, Kansas, Kentucky, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Utah, Virginia, Washington and West Virginia, Wisconsin, Wyoming. The states in which the dominant factor test is not used are : Arizona , Arkansas , Florida , Illinois , Iowa , Louisiana and Maryland .
